Recent federal announcements indicate that provincial and municipal governments must be prepared for retail cannabis locations to start operating by mid-August 2018. The Committee recommended two Land Use Bylaw (LUB) amendments to regulate permissible retail cannabis (Cannabis Store) locations. The recommendations include the adoption of 'Cannabis' as a defined use (type of business establishment) in the LUB and legislation of required separation distances between Cannabis Stores and other specific business types such as hospitals, emergency centres, schools and daycares. The recommendations do aim to align with all levels of government but because the provincial government has not yet released draft legislation, municipal bylaws may require future amendments. The current recommendations will give businesses an understanding of where Cannabis Stores can be located and allow The City to respond to business permit requests. Council members elected to drop post-secondary institutions from a rule preventing cannabis stores from opening within 150 metres of schools. They also voted to relax policies related to how close a Cannabis Store can be located to a payday lender or liquor store (from 30 metres to 10 metres and from 30 metres to non-adjacent, respectively). Council will hold a Public Hearing at the April 5, 2018 Combined Meeting of Council. This will give administration time to advertise these recommendations and give the public an opportunity to respond.
